General Terms and Conditions

Entry

By entering the racecourse and any area of Gold Coast Turf Club (GCTC) you are deemed to have accepted these terms and conditions of entry. You enter the racecourse at your own risk and GCTC takes no responsibility for any injury to any person (including injury resulting in death), damage or loss of property occurring on or about the racecourse whatsoever.



GCTC reserves the right to refuse entry to or forcibly remove anyone from the racecourse who in the opinion of GCTC or any of their representatives:



Is behaving in a manner which is aggressive, causing or likely to cause disruption, nuisance or offence to other patrons including harm to persons, horses or damage to property;

• Is dressed inappropriately or contrary to GCTC’s dress code;

• Appears in any way intoxicated or under the influence of alcohol or drugs;

• Is caught attempting to bring inside or consume their own alcohol or illicit drugs, in which case their ticket will be immediately forfeited and they will be removed from the premises.

Any illicit drugs found will be referred to the police directly to be dealt with accordingly;

• Is caught attempting to or has acted in a way that may bring the GCTC or the wider racing industry into disrepute; and/or

• Has not followed these terms and conditions of entry



GCTC has a strict policy against patrons causing any disturbance while at GCTC or interfering with events/races that may or may not result in inhabiting the event, causing delays or harming other patrons. Should a patron cause a disturbance that interferes with the integrity of GCTC then GCTC reserves the right to forcibly remove them, refer the matter to police or other regulatory bodies, including but not limited to Racing Queensland. GCTC may also implement a lifetime ban or another timeframe they deem appropriate in the circumstances.



Anyone who is refused entry or forcibly removed from GCTC will not be permitted re-entry or entitled to a refund and instead will immediately forfeit their ticket.



Searches

GCTC reserve the right to search bags, personal property, clothing, pockets, items or any other objects to ensure compliance with the conditions of entry. Failure to comply with a search required by GCTC or GCTC representatives will result in refusal of entry and forfeiture of ticketing with no entitlement of a refund or exchange.



Prohibited at GCTC

The following is strictly prohibited (searches may be undertaken to ensure compliance):

• No animals other than service and support animals are to be brought to the racecourse or involved in events (unless a written exception has been provided by GCTC);

• No access to the racetrack (including the course proper) at any time unless with express authority from GCTC;

• No selling, distributing any goods or advertising, promotional or political materials or similar.

• No items that could be used as potential weapons such as knives, chains or studs;

• No outside food, alcohol or illegal substances;

• No flares, fireworks, horns, instruments, whistles or other items which may cause alarm or harm to animals or others; and/or

• No protesting.



Patrons may be required to provide proof of identity to confirm their age at any time while at the racecourse. GCTC retains the right to refuse entry to any person or to withdraw any person’s permission to remain on the premises whatsoever at their sole direction.



Ticketing

For the purposes of the below ticketing provisions, commencement of an event or booking (‘Commencement’) means the time as listed for the gate opening at GCTC or time as listed on the ticket, whichever occurs first.



General Admission

General admission tickets are considered non-refundable and purchased with the understanding that there are no refunds available under any circumstances including if the event is:

(a) rescheduled to a new date;

(b) cancelled prior to Commencement; or

(c) cancelled after the Commencement for any reason whatsoever.



If GCTC receive an exchange or refund request for a general admission ticket more than fourteen (14) days prior to the scheduled event, GCTC may at their sole discretion approve or deny the refund or exchange request for a new raceday date within the same calendar year. Any exchange request must

be initiated through the GCTC ticketing platform (Eventbrite).



GCTC reserves the right to charge an administration fee (amount to be determined at GCTC’s sole discretion) should GCTC approve a refund request which is received more than fourteen (14) days prior to the scheduled event.



General Admission ticketing is any type of General Admission ticket including but not limited to activations such as The Palms, GG’s Booth Bookings and Trackside Trifecta tickets.



Members Day Passes

Members day pass tickets are considered non-refundable and purchased with the understanding that there are no refunds available under any circumstances including if the event is:

(a) rescheduled to a new date;

(b) cancelled prior to Commencement; or

(c) cancelled after the Commencement for any reason whatsoever.



If GCTC receive an exchange or refund request for a members day pass ticket more than fourteen (14) days prior to the scheduled event, GCTC will either provide a refund or transfer this ticket to a new raceday date within the same calendar year. The new raceday ticket may be the same value, higher in value or less than the original members day pass ticket. Any difference in value may be forfeited by choosing to transfer the date, be lost, and considered a passthrough cost. If the new raceday ticket value is above the original price paid, the difference in price will apply and is payable in order for the new ticket to be issued.



The above applies to members day pass tickets purchased though the GCTC ticketing platform known as Eventbrite or through a GCTC representative. This exchange request must be initiated though the avenue used to purchase the members day pass ticket.



GCTC reserves the right to charge an administration fee (amount to be determined at GCTC’s sole discretion) should GCTC approve a refund request which is received more than fourteen (14) days prior to the scheduled event.



Members day passes tickets are not valid for use or redeemable for any feature race days including but not limited to Magic Millions race day at the sole discretion of GCTC.



At any given time GCTC reserves the right to refuse or permit entry into the members areas. GCTC at their sole discretion may vary the areas allocated for the members day passes.



Private Raceday Bookings

Private raceday are bookings that have been allocated a private area or a space that is separated from the members areas or the public by a door, bollard or where other patrons cannot freely enter without the specific ticket issued to them by the organiser of the private raceday event or by GCTC directly.



Private raceday bookings are considered non-refundable, no refund or exchanges will be provided except if a raceday is cancelled or rescheduled prior to the Commencement as listed on the ticket confirmation and ticket and a phantom meeting is not run on the original date then the main booking contact may:

(a) request the booking is exchanged for an equivalent date by writing to GCTC and requesting their private event be rescheduled to a new date. GCTC will, if available, provide an exchanged date (but does not provide any guarantee that it will do so). For clarity, an equivalent event means an event or raceday of similar standard and within the same calendar year; or

(b) if a raceday is cancelled or rescheduled on the day of the event and a phantom meeting is run (whereby no racing occurs at GCTC but live broadcasting from other race clubs on televisions is available), then the booking organiser must proceed with their event and GCTC will not be liable for any refund whatsoever.



Once the numbers are confirmed for a private raceday event they cannot decrease, and no refunds will be provided in this respect.



Should the booking organiser want to cancel their private raceday booking this must be communicated in writing to an events representative of GCTC. If cancellation is received thirty (30) days or more from the event date, GCTC may offer (at GCTC’s sole discretion) to transfer the booking to another date, with payments received transferred across to secure the new date, resulting in no penalty. If cancellation is received within thirty (30) days of event date, all payments received will be retained with no option to transfer any deposit paid to a rescheduled booking and is subject to a 100% cancellation fee. All payments received for private raceday bookings are non-refundable and refunds will not be offered at any stage for cancellations.



The booking organiser has a responsibility to ensure that all guests attending the event are aware of the conditions outlined in these terms and conditions. The following applies to private raceday bookings and tickets issued and held at GCTC:

• GCTC at all times reserves the right to cancel, reschedule or vary advertised events and raceday events at their sole discretion.

• GCTC does not guarantee the event for which a ticket is issued will take place at the date, time or venue indicated on the ticket or in the associated contract.

• No refund or compensation will be provided if a patron chooses not to attend, an event finishes early or entrance is delayed for any reason.

• Once final payment has been received by GCTC tickets will be posted to the address nominated when booking (or via collection if deemed appropriate by GCTC). If ticketing is issued in the form of a wristband it must be visible at all times and worn by attendees while on course.

• Tickets must not be resold or offered for resale at a premium including online auction sites nor used for promotion or advertising purposes in connection with goods or services, without express written consent of GCTC.

• Should a wristband or ticket be stolen, GCTC will require a written request for replacement (at least one week prior to the event). GCTC takes no responsibility for lost or stolen wristbands or tickets.

No guarantee is given that replacements will be re-issued and only the person who purchased the ticket can make such a request.

• GCTC is not liable to refund any fees or charges paid to third parties (including banks) or other additional fees related to purchasing tickets nor provide refunds of any kind for tickets purchased through non-authorised ticket sellers.

• All payments received for event bookings are non-refundable. Refunds will not be offered at any stage for cancellations.

• Any refunds provided are entirely at the discretion of GCTC and are not a right or an obligation.



Hospitality Events

Hospitality events are raceday bookings that have been allocated a non-exclusive area such as a table of ten (10) or a ticket of varying quantities that may be a cocktail style or seated event including reserved or non-reserved seating. Hospitality events are events specifically ticketed through GCTC.



Hospitality events are considered non-refundable, no refund or exchanges will be provided except if a raceday or event is cancelled or rescheduled (other than for Covid, health or pandemic related issues) prior to the Commencement as listed on the ticket confirmation and ticket, and a phantom meeting is not run on the original date, then ticket holder may:

(a) request the ticket is exchanged for an equivalent event by requesting this through the GCTC ticketing platform (Eventbrite) within two business days of the cancelled or rescheduled event (but prior to the date the event was scheduled). GCTC will, if available, provide an exchanged ticket (but does not provide any guarantee that it will do so). For clarity, an equivalent event means an event or raceday of similar standard within the same calendar year; or



(b) return the tickets by requesting this through Eventbrite within fourteen (14) days of the cancelled or rescheduled event (but prior to the date the event was scheduled) to obtain a refund of the price paid, excluding any bookings charges or fees.



If GCTC receive an exchange request for a hospitality event ticket more than fourteen (14) days prior to the scheduled event, GCTC will at their discretion transfer this ticket to a new date within the same calendar year. The new ticket may be the same value, higher in value or less than the original hospitality event ticket. Any difference in value may be forfeited by choosing to transfer the date, be lost, and considered a passthrough cost. If the new ticket value is above the original price paid, the difference in price will apply and is payable in order for the new ticket to be issued.



The above applies to hospitality event ticketing purchased though the GCTC ticketing platform (known as Eventbrite) or through a GCTC representative. This exchange request must be initiated though the avenue used to purchase ticket. Any exchange in ticketing is at the sole discretion of GCTC.



The following applies to hospitality event tickets issued and events held at GCTC:

• GCTC at all times reserves the right to cancel, reschedule or vary advertised events and raceday events at their sole discretion.

• GCTC does not guarantee the event for which a ticket is issued will take place at the date, time or venue indicated on the ticket or in the associated contract.

• No refund or compensation will be provided if a patron chooses not to attend, an event finishes early or entrance is delayed for any reason.

• Once final payment has been received by GCTC tickets will be posted to the address nominated when booking (or via collection if deemed appropriate by GCTC). If ticketing is issued in the form of a wristband it must be visible at all times and worn by attendees while on course.

• Tickets must not be resold or offered for resale at a premium including online auction sites or without the written permission of GCTC, nor used for promotion or advertising purposes in connection with goods or services.

• Should a wristband or ticket be stolen, GCTC will require a written request for replacement (at least one week prior to the event). GCTC takes no responsibility for lost or stolen wristbands or tickets.

No guarantee is given that replacements will be re-issued and only the person who purchased the ticket can make such a request.

• GCTC is not liable to refund any fees or charges paid to third parties (including banks) or other additional fees related to purchasing tickets nor provide refunds of any kind for tickets purchased through non-authorised ticket sellers.

• All payments received for event bookings are non-refundable. Refunds will not be offered at any stage for cancellations.

• Any refunds provided are entirely at the discretion of GCTC and are not a right or an obligation.

• This policy applies to any ticketing purchased including but not limited to; singular tickets, multiple single tickets or tables of ten (10) or more.



Restaurant Bookings

All restaurant bookings are considered non-refundable, no refund or exchanges will be provided except if a raceday or event is cancelled or rescheduled prior to the Commencement as listed on the ticket confirmation and ticket and a phantom meeting is not run on the original date, in which case the ticket holder may:

(c) request the ticket is exchanged for an equivalent event by requesting this through Eventbrite within two business days of the cancelled or rescheduled event (but prior to the date the event was scheduled). GCTC will, if available, provide an exchanged ticket (but does not provide any guarantee that it will do so). For clarity, an equivalent event means a restaurant booking for an event or raceday of similar standard within the same calendar year; or

(d) return the tickets by requesting this through Eventbrite within fourteen (14) days of the cancelled or rescheduled event (but prior to the date the event was scheduled) to obtain a refund of the price paid, excluding any bookings charges or fees.



If GCTC receive an exchange request for a restaurant ticket more than fourteen (14) days prior to the scheduled event, GCTC will at their discretion transfer this ticket to a new date within the same calendar year. The new ticket may be the same value, higher in value or less than the original restaurant ticket. Any difference in value may be forfeited by choosing to transfer the date, be lost, and considered a passthrough cost. If the new ticket value is above the original price paid, the difference in price will apply and is payable in order for the new ticket to be issued.



The above applies to restaurant ticketing purchased though the GCTC ticketing platform (known as Eventbrite) or through a GCTC representative. This exchange request must be initiated though the avenue used to purchase ticket. Any exchange in ticketing is at the sole discretion of GCTC.



In the event a ticket holder does not attend the restaurant for their allocated booking or is later than 30 minutes and has prepaid or been allocated a gift voucher then their ticket will be forfeited.



The following applies to restaurant bookings and restaurant tickets issued and held at GCTC:

• GCTC at all times reserves the right to cancel, reschedule or vary advertised events and raceday events at their sole discretion.

• GCTC does not guarantee the event for which a ticket is issued will take place at the date, time or venue indicated on the ticket or in the associated contract.

• No refund or compensation will be provided if a patron chooses not to attend, an event finishes early or entrance is delayed for any reason.

• Once final payment has been received by GCTC tickets will be posted to the address nominated when booking (or via collection if deemed appropriate by GCTC). If ticketing is issued in the form of a wristband it must be visible at all times and worn by attendees while on course.

• Tickets must not be resold or offered for resale at a premium including online auction sites or without the written permission of GCTC, nor used for promotion or advertising purposes in connection with goods or services.

• Should a wristband or ticket be stolen, GCTC will require a written request for replacement (at least one week prior to the event). GCTC takes no responsibility for lost or stolen wristbands or tickets.

No guarantee is given that replacements will be re-issued and only the person who purchased the ticket can make such a request.

• GCTC is not liable to refund any fees or charges paid to third parties (including banks) or other additional fees related to purchasing tickets nor provide refunds of any kind for tickets purchased through non-authorised ticket sellers.

• All payments received for event bookings are non-refundable. Refunds will not be offered at any stage for cancellations.

• Any refunds provided are entirely at the discretion of GCTC and are not a right or an obligation.

• Seating in the restaurants at the GCTC may have obstructed or partially obstructed views. GCTC makes no guarantee that each seat will have a full view of the racecourse as some restaurant seating has partially restricted views.

• Purchase of tables into the restaurants is limited to one (1) table per customer, per race day on semi-feature and feature Racedays as deemed by the GCTC (including but not limited to Magic Millions raceday). Any variations to this limit are to be approved or denied at the sole discretion of the GCTC.



Specialised Events

Specialised events include but are not limited to Racing Industry Awards and Calcutta events and tickets are considered non-refundable, no refund or exchanges will be provided except as outlined below.



Should a patron want to cancel their specialised event ticket this must be communicated in writing to an events representative of GCTC. If a cancellation is received thirty (30) days or more from the event date, GCTC may offer (at GCTC’s sole discretion) to transfer the ticket to another event of a similar nature within the same calendar year, with payments received transferred across to secure the new ticket, resulting in no penalty. The new ticket may be the same value, higher in value or less than the original ticket value. Any difference in value may be forfeited by choosing to transfer the date, be lost, and considered a passthrough cost. If the new ticket value is above the original price paid, the difference in price will apply and is payable in order for the new ticket to be issued. If cancellation is received within thirty (30) days of event date, all payments received will be retained with no option to transfer any payment made to a rescheduled event and is subject to a 100% cancelation fee. All payments received for specialised event bookings are non-refundable and refunds will not be offered at any stage for cancellations.



The person named for the booking (for a table or multiple tickets) has a responsibility to ensure that all patrons attending the event are aware of all conditions outlined in these terms and conditions.



The following applies to specialised events tickets issued and events held at GCTC:-

• GCTC at all times reserves the right to cancel, reschedule or vary advertised events and raceday events at their sole discretion.

• GCTC does not guarantee the event for which a ticket is issued will take place at the date, time or venue indicated on the ticket or in the associated contract.

• No refund or compensation will be provided if a patron chooses not to attend, an event finishes early or entrance is delayed for any reason.

• Once final payment has been received by GCTC tickets will be posted to the address nominated when booking (or via collection if deemed appropriate by GCTC). If ticketing is issued in the form of a wristband it must be visible at all times and worn by attendees while on course.

• Tickets must not be resold or offered for resale at a premium including online auction sites or without the written permission of GCTC, nor used for promotion or advertising purposes in connection with goods or services.

• Should a wristband or ticket be stolen, GCTC will require a written request for replacement (at least one week prior to the event). GCTC takes no responsibility for lost or stolen wristbands or tickets.

No guarantee is given that replacements will be re-issued and only the person who purchased the ticket can make such a request.

• GCTC is not liable to refund any fees or charges paid to third parties (including banks) or other additional fees related to purchasing tickets nor provide refunds of any kind for tickets purchased through non-authorised ticket sellers.

• All payments received for event bookings are non-refundable. Refunds will not be offered at any stage for cancellations.

• Any refunds provided are entirely at the discretion of GCTC and are not a right or an obligation.

• This policy applies to any ticketing purchased including but not limited to; singular tickets, multiple single tickets or tables of ten (10) or more.



All Tickets

The following overrides the above terms and conditions and applies to all tickets issued and events held at GCTC:

• GCTC at all times reserves the right to cancel, reschedule or vary advertised events and raceday events at their sole discretion.

• GCTC does not guarantee the event for which a ticket is issued will take place at the date, time or venue indicated on the ticket or in the associated contract.

• No refund or compensation will be provided if a patron chooses not to attend, an event finishes early or entrance is delayed for any reason.

• Once final payment has been received by GCTC tickets will be posted to the address nominated when booking (or via collection if deemed appropriate by GCTC). If ticketing is issued in the form of a wristband it must be visible at all times and worn by attendees while on course.

• Tickets must not be resold or offered for resale at a premium including online auction sites or without the written permission of GCTC, nor used for promotion or advertising purposes in connection with goods or services.

• Should a wristband or ticket be stolen, GCTC will require a written request for replacement (at least one week prior to the event). GCTC takes no responsibility for lost or stolen wristbands or tickets.

No guarantee is given that replacements will be re-issued and only the person who purchased the ticket can make such a request.

• GCTC is not liable to refund any fees or charges paid to third parties (including banks) or other additional fees related to purchasing tickets nor provide refunds of any kind for tickets purchased through non-authorised ticket sellers.

• All payments received for event bookings are non-refundable. Refunds will not be offered at any stage for cancellations.

• Any refunds provided are entirely at the discretion of GCTC and are not a right or an obligation.

• Resale of all ticketing is strictly prohibited by GCTC, unless express written consent is received by GCTC in every instance. If GCTC is made aware of resale of ticketing without consent this will result in the cancellation and forfeiture of the tickets in question with no entitlement of a refund.

• Purchasing of multiple ticketing with the intent to re-sell is strictly prohibited.

• No refunds will be issued for Covid, health or pandemic related issues, except at the sole discretion of GCTC.



Gift Certificates

Restaurant gift certificates are considered non-refundable and purchased with the understanding that there are no refunds available under any circumstances including if the gift certificate is not redeemed within the designated validity period, lost or stolen.



A gift certificate can only be redeemed during its validity period.



Liquor and Responsible Service of Alcohol (RSA)

Alcohol must not be removed from the racecourse. It is an offence to sell, supply or obtain liquor on behalf of a persons under the age of eighteen (18) years old. Persons under the age of eighteen (18) years old are not permitted to consume alcohol. Persons under the age of eighteen (18) are not permitted to enter the racecourse unless they are accompanied by their parent or legal guardian. If a minor is deemed to be in breach of any terms and conditions of entry, both the minor and guardian will be refused entry and/or removed from the premises.



Parents and guardians entering with minors accept full responsibility of the minor for the duration of the event and while at the premises. Certain events will be restricted to persons under the age of eighteen (18) years old and they will not be permitted entry.



Car Parking

Entry into and parking or leaving of vehicles in the car park or anywhere at the racecourse is at the risk of the owner. GCTC is not responsible for any damage or theft in regard to vehicles or any personal property. Patrons must not leave bags or personal property unattended at any time and should remove all valuables from their vehicles prior to entering.



Wagering and Responsible Service of Gambling (RSG)

It is an offence to transmit the betting odds being offered by bookmakers on any horse from the racecourse during an event. Anyone under the age of eighteen (18) years old is not permitted to gamble and if caught GCTC reserves the right to remove them from the racecourse.



Smoking Areas

All patrons must follow GCTC and their representative’s directions and all signage regarding smoking in the smoke free areas of the racecourse as required by law. GCTC has designate smoking areas clearly marked to be used accordingly. Patrons found smoking in any other areas of the racecourse including bathrooms will be removed and their tickets confiscated with no refunds provided. Smoking is only permitted in the specific areas allocated.



Photography, Filming & Recording

Upon attending an event at the racecourse each patron accepts and acknowledges they may be photographed, filmed or recorded in any way and:

• Consents to being photographed, filmed and recorded by or for GCTC for advertising and promotional purposes;

• If a patron is an owner of a horse whose image is displayed, consents to their horse being photographed, filmed or recorded by or for GCTC and for use of such images and recordings for advertising and promotional purposes;

• Assigns any and all intellectual property rights the patron has in any photographs and recordings to GCTC including all right, title, interest and ownership in perpetuity free from any claims, encumbrances or rights; and

• Waives any rights they have or will have in relation to any photographs, files or recordings absolutely for GCTC to use at their sole discretion and in accordance with the Privacy Policy.



Patrons must not, unless provided with written authority from GCTC, take any photographs or make any films, video, digital or other recordings within the racecourse for commercial purposes. No sale or distribution of goods or material is permitted. Patrons must not attempt to sell or distribute any goods or create advertising or similar of any person attending the racecourse or conduct any advertising, promotional or political campaign anywhere in the racecourse, without the express written authority of GCTC.



Breach of Conditions of Entry

In the event that a patron breaches any of the above terms and conditions of entry, GCTC (within reason) may do any of the following:

• Refuse entry;

• Remove the patron from the racecourse;

• Require surrendering of certain items from possession if considered illegal;

• Have tickets confiscated, surrender or cancelled; and/or

• Report to police any illegal or suspected illegal actively.



Overarching Right

The Chief Executive Officer, GCTC Representative or GCTC Security may refuse entry or revoke entry to any person at their sole discretion and may exercise this right over their private land for any reason, at any time.



Breach of the above conditions may result in the immediate cancellation of a ticket, refusal of entry or removal to the ticket holder prior or during an event. There will be no refund or compensation of any kind to patrons who are refused entry or removed from the racecourse for breaching the above terms and conditions of entry.
